Terms and Conditions
 
1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions.
 
2. The promoter of the Just Car Insurance Cover Car Competition ("Competition") is Just Car Insurance Agency Pty Ltd (ABN 41 050 238 563) of 601 St Kilda Road, Melbourne, Victoria 3004 ("Promoter").
 
3. Entry is only open to Australian residents aged 15 years or older who hold an active ‘Facebook’ account (“Facebook”). Employees (and their Immediate Family Members) of the Promoter or of any related body corporate of the Promoter or of any agency associated with this Competition are ineligible to enter. “Immediate Family Members” means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. A person who meets the entry criteria described in this clause is known as an Entrant (“Entrant”).
 
4. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.
 
5. This Competition is made up of three separate promotional periods (“Promotional Periods”), each with a separate single prize winner (“Prize Winner”). The Promotional Periods are:

 6. To enter the Competition, an Entrant must upload a photograph of their own car to Instagram and assign the hashtag #JCICoverCar in the photo caption. Photographs should contain the full car, with no objects between it and the camera. Photographs should not contain any people, animals or objects in the immediate vicinity of the car. Entrants agree to take reasonable precautions when considering the location and aspect of the photograph (for example, the background building/street or car’s registration number) to ensure their personal privacy or their car’s security isn’t compromised. The Promoter encourages Entrants to photograph their car in a public space well away from their residential address.

7. Cost of entry via the internet is free, but internet connection and usage rates may apply. Entrants should obtain details of such costs from their service providers. Instagram is a free mobile phone application operated by Instagram Incorporated and available on both iPhone and Android platforms. Instagram can be downloaded to your mobile device through Apple’s App Store or Google Play. Visit http://instagr.am/ for information and download instructions for the Instagram application.

8. Entries must be received during the relevant Promotional Period. A limit of one photograph per Entrant per Promotional Period applies. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.

9. The Competition is a game of skill and chance plays no part in the selection of the Winners.

10. Judging will take place at 601 St Kilda Road, Victoria on the Winner selection dates shown in term 5, at 9:00am AEST. Entries will be judged by the Promoter based on creativity and visual aesthetic (“Criteria”). The Prize Winner of a Promotional Period will be the entry judged to be the best. The Promoter’s decision will be final and no correspondence will be entered into.

11. Fifteen (15) finalists from each Promotional Period will have their photo uploaded into an online album to be housed on the Just Car Insurance Facebook page. From these photos Prize Winners will be selected by the Promoter during the relevant Promotional Period. The Prize Winner’s prize is to have their winning photo feature as the cover photo on Just Car Insurance’s Facebook page for one calendar month, as set out in clause 5. There is no monetary value attributable to the prize.

12. By entering this Competition an Entrant additionally agrees to the Promoter’s Online Terms & Privacy Statement, together with any standard terms of use and privacy statement of Instagram. For the avoidance of doubt, an Entrant agrees that photos submitted to this Competition, which are judged as finalists and are uploaded to the Promoter’s Facebook page will be deemed Social Media Site User Content in accordance with the Promoter’s Online Terms & Privacy Statement. The Promoter specifically refers Entrants to terms 9 and 27 as to the likely or potential uses of Social Media Site User Content.

13. The Promoter reserves the right to modify any of these Terms and Conditions in order to comply with changes to Facebook or Instagram’s promotional guidelines.

14. The Promoter reserves the right, at any time, to verify the validity of entries and each Entrant (including any Entrant’s identity, eligibility and age) and to disqualify any Entrant who has breached the entry criteria explained in these Terms and Conditions.

15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition.

16. This website uses the Instagram(tm) API and is not endorsed or certified by Instagram or Instagram, Inc. All Instagram(tm) logos and trademarks displayed on this website are property of Instagram, Inc.

17. Privacy Statement. The Entrant agrees that the Promoter collects their personal information in order to conduct the Competition and otherwise handles their personal information in accordance with the Promoter’s Online Terms & Privacy Statement.
